DILEMA IJTIHAD DAN LEGISLASI: MEMBANDINGKAN HUKUMAN PELAKU PEDOFILIA DALAM HUKUM POSITIF DAN ISLAM DI INDONESIA

This research employs a comparative-normative and philosophical method to examine the dilemma between Islamic Sharia Ijtihad and Child Protection Law Legislation regarding the punishment of pedophilia perpetrators. The theories utilized center on Responsive Law and Ta'zir Ijtihad within the framework of Maqaṣid Shari'ah (Hifz al-'Irdh). The results show that Indonesian legislation successfully synchronizes the maximum sanctions (Death Penalty and Chemical Castration) with Ta'zir based on Maslahah Mursalah. However, structural conflicts in implementation (disparity in verdicts and the deadlock of Chemical Castration) undermine the deterrent effect, signifying the failure of Implementative Ijtihad. Structural consistency and the strengthening of restorative justice are urgently needed
